Section 111 Mandatory Reporting Requirements for Liability and Workers' Compensation Programs

Congress passed mandatory reporting provisions to Section 111 of the Medicare, Medicaid and SCHIP Extension Act of 2007. The new reporting requirements affect group health plans, liability insurance carriers, self-insured organizations, workers’ compensation carriers and self-insured employers, referred to as Responsible Reporting Entities (RRE). Section 111 enables the Centers for Medicare and Medicaid Services (CMS) to pay correctly for Medicare covered items and services furnished to Medicare beneficiaries by determining primary versus secondary payer responsibility.

Under Section 111, if an organization or entity is self-insured for liability or workers' compensation and makes payments to Medicare beneficiaries, the organization or entity must register and report such claim payments to CMS. Registration is going on now and must be completed no later than September 30, 2090. A complete user guide and more detailed information can be found by visiting www.cms.hhs.gov/MandatoryInsRep.
